Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Han Zhe Ting, an individual developer doing business as "Sous" ("Sous", "we", "us", or "our"), governing your access to and use of the Sous mobile application (the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (16 in the European Economic Area, the United Kingdom, and Switzerland) to use the App. The App is not directed at children below that age, and we do not knowingly allow them to create an account. If you are a parent or guardian and believe a child has provided us with personal information, contact us at privacy@sousrecipe.com and we will delete it.

2. Your Account

You can create an account with an email and password, or by signing in with Google or Apple. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity under your account. Tell us right away at support@sousrecipe.com if you suspect unauthorized access.

3. Subscriptions and Billing

Sous offers an optional "Premium" subscription that unlocks additional features, including a higher monthly allowance for AI-powered recipe processing (recipe extraction and AI-generated recipes). That allowance is metered by the AI compute each request consumes, not by access to any specific third-party source such as YouTube. Subscriptions are auto-renewing and are billed and processed entirely by the Apple App Store or Google Play, depending on where you subscribed โ€” Sous never receives or stores your payment card details. We use RevenueCat solely to check which entitlements are active on your account; RevenueCat does not process payments.

Price, billing period, and any free-trial length are shown in the App at the time of purchase. Unless you cancel at least 24 hours before the end of the current period, your subscription renews automatically at the price then in effect, charged to the payment method on file with Apple or Google. You manage or cancel your subscription through your Apple ID or Google Play account settings โ€” not within the App โ€” and cancellation takes effect at the end of the current billing period. Refunds are handled by Apple or Google under their own policies; we cannot issue refunds directly. We may change subscription pricing with advance notice as required by the applicable app store and law.

4. Your Content and License to Us

You retain ownership of the recipes, photos, notes, meal plans, grocery lists, messages, and other content you create or upload ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it solely to operate and provide the App to you and to anyone you choose to share it with (a friend or a cookbook's members). We do not claim ownership of Your Content, and we do not sell it.

You are responsible for Your Content and must have the right to share anything you upload. Recipes extracted from a YouTube link remain the intellectual property of their original creator; Sous produces an AI-generated summary of a public video for your personal use and links back to the source โ€” it does not claim authorship of that creator's recipe or copy their video.

5. Copyright Complaints

We respect intellectual property rights and remove infringing content when properly notified. If you believe content in the App infringes your copyright, send a notice to copyright@sousrecipe.com including: (a) a description of the copyrighted work; (b) the location of the material in the App (e.g. the recipe or the user who posted it); (c) your name, address, phone number, and email; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, under penalty of perjury, that the notice is accurate and that you are the rights holder or authorized to act on their behalf. We will remove or disable access to the reported content and may terminate the account of a user who is a repeat infringer.

6. AI-Generated Content

Some features (extracting a recipe from a YouTube link, generating a recipe from a dish name, suggesting a grocery-aisle category) use an AI model to produce content. AI output can be inaccurate or incomplete โ€” including ingredient quantities, cooking times, substitutions, and allergen information. Always use your own judgment and check ingredients yourself before cooking or eating, especially if you have an allergy or medical dietary restriction. Sous is not liable for any harm arising from reliance on AI-generated or AI-extracted content.

7. Friends, Cookbooks, and Shared Content

Adding a friend or joining a shared "cookbook" lets other people see content you choose to share with them (recipes, your profile name/photo/bio, likes, and messages in a shared conversation). If you remove a friend or leave a cookbook, past shared messages are not retroactively deleted from the other participants' view. Be respectful of others; you can block or report a user from within the App.

8. Acceptable Use

You agree not to: violate any law; infringe someone else's intellectual property or privacy; harass, impersonate, or abuse another user; upload malicious code; attempt to reverse-engineer the App; scrape, bulk-extract, or resell data from the App or its AI features; circumvent usage limits; or interfere with the App's normal operation. We may suspend or terminate accounts that violate this section.

9. Termination

You may stop using the App at any time and delete your account from Settings โ†’ Account. Account deletion requires confirming your identity and is immediate and permanent โ€” your recipes, collections, meal plans, grocery lists, friendships, and messages are erased and cannot be recovered by us. Before deleting, you can export your recipes and collections to a file from Settings โ†’ Export, and restore them into a new account later using Import. We may suspend or terminate your access if you violate these Terms.

10. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any recipe (AI-generated or user-submitted) is safe, accurate, or suitable for your dietary needs.

11. Limitation of Liability

To the fullest extent permitted by law, Sous and Han Zhe Ting will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App, even if advised of the possibility of such damages. Our total liability for any claim relating to the App will not exceed the amount you paid us in subscription fees in the 12 months before the claim arose.

12. Indemnification

You agree to indemnify and hold harmless Sous and Han Zhe Ting from any claim or demand, including reasonable legal fees, arising out of Your Content, your violation of these Terms, or your violation of any law or a third party's rights.

13. Apple and Google Terms

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Sous only, not Apple, and Apple has no obligation to furnish any maintenance or support for the App. Apple is not responsible for addressing any claims relating to the App. Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce them against you. Your use of the App must also comply with Apple's Media Services Terms and Usage Rules.

If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service.

14. Changes to These Terms

We may update these Terms from time to time. If a change is material, we will notify you in the App or by email before it takes effect. Continuing to use the App after a change takes effect means you accept the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles. Before filing a claim, please contact us at support@sousrecipe.com so we can try to resolve the issue informally. Any dispute that cannot be resolved informally is subject to the exclusive jurisdiction of the courts of Malaysia, except where applicable consumer-protection law in your country of residence gives you the right to bring a claim in your local courts instead.
